The New Mexico Legislature passed the Healthy Workplaces Act (“HWA”) in 2021, with an upcoming and all-important effective date of July 1, 2022. The HWA will impact the overwhelming majority of employers in the state of New Mexico, thereby necessitating the importance of gaining a prompt and thorough understanding of the legal requirements set forth in the Act. At its core, the HWA requires employers to provide paid sick leave to covered employees for a broad range of “qualifying events.”
Employers will also be responsible for calculating and tracking paid sick leave banks for each employee to ensure compliance. Posting requirements also exist, with posters currently available on-line.
The Learning Objectives Include:
● Review in detail the statutory obligations that exist for employers
● Highlight the definitional section of the HWA
● Review Employer’s obligations to provide paid sick leave, in what circumstances, and what notice requirements should be obtained.
● Other important considerations such as revising leave policies and ways to anticipate and trouble shoot as leave requests arrive.
About Our Speaker
Mr. Stanford is a partner at Moody & Stanford, PC. He is a 2002 graduate of the University of New Mexico School of Law where he received the Torts Scholar Award. He holds a B.A. degree from Vanderbilt University and attended graduate school for three years at the University of New Mexico before attending law school.
Mr. Stanford has significant trial experience in employment matters and concentrates his legal practice in the areas of labor and employment law, including discrimination, harassment, retaliation, wage and hour, employment contracts, labor arbitration, and employment consultation. Mr. Stanford has worked in the employment and labor law field since June of 2001.
Mr. Stanford represents employers in all types of labor and employment law matters, including arbitrations, unfair labor practice and representation proceedings before the National Labor Relations Board, administrative hearings before federal and state Department of Labor tribunals, the Equal Employment Opportunity Commission, the New Mexico Human Rights Commission, state and federal audits, and litigation, trial and appellate work in both federal and state courts. Mr. Stanford also represents employees in discrimination, retaliation, employment agreements, and wage and hour matters. He continues to be involved in a number of class action lawsuits, primarily wage and hour lawsuits, at both the federal and state level.
